Terms of Service

1. Eligibility

• You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to access the Site, create an account, or place an order.
• If you are using the Site or purchasing Products on behalf of a business, organization, or other entity, you represent and warrant that you have the legal authority to bind that entity to these Terms.
• We reserve the right to refuse service to any person or entity at our sole discretion, for any reason, at any time.

2. Orders & Acceptance

• Placing an order on the Site constitutes an offer to purchase our Products at the listed price (including applicable tax and shipping costs). This offer is only valid for a reasonable time (72 hours) and is subject to Product availability.
• We reserve the right to accept or reject your order for any reason, in our sole discretion, including but not limited to: Product unavailability, pricing errors (typos, incorrect listings), suspected fraudulent or unauthorized payment/order activity, incomplete/invalid shipping/billing information, or violations of these Terms.
• Your order is officially accepted only when we ship your Products and send a shipping confirmation email with tracking information to your registered email address. No other communication (e.g., order confirmation email) constitutes acceptance of your order.
• We may cancel any unshipped order at any time, in our sole discretion, and will issue a full refund to your original payment method for any canceled unshipped order (no fees or penalties).

3. Pricing & Payment

• All Product prices are listed in U.S. Dollars (USD) and are subject to change without prior notice. We do not honor price adjustments for past orders (including orders placed before a sale or price increase).
• Prices listed on the Site do not include applicable sales tax (Oklahoma state and local tax, where required by law) or shipping costs—these are added at checkout and are clearly displayed before you complete payment.
• We accept major credit/debit cards (Visa, Mastercard, American Express, Discover) and other payment methods displayed at checkout—all payments are processed by PCI DSS-compliant third-party payment providers. We do not store full payment card details on our systems.
• You authorize us to charge your selected payment method for the total order amount (Product price + tax + shipping) at the time of purchase. If your payment is declined, your order will be canceled, and you will need to resubmit your order with a valid payment method.
• You represent and warrant that you have the legal right to use the payment method you provide (e.g., you are the cardholder or have authorized access to the card).

4. Product Information & Availability

• We make reasonable efforts to display accurate Product information on the Site, including images, descriptions, materials, sizing, and pricing. However, minor handcrafted variations (color, bead placement, slight shape/hammer differences) are part of the artistry and are not considered defects—these variations may differ from the product images on the Site.
• Screen/lighting differences (on your device) may cause slight visual variations between the Product images on the Site and the actual jewelry—we do not guarantee exact color matching.
• Product availability is not guaranteed until your order is shipped. We reserve the right to discontinue, modify, or update any Product at any time, without prior notice, and to limit the quantity of Products sold per customer/order.
• We are not liable for any errors in Product information (e.g., typographical errors, incorrect material listings) and reserve the right to correct such errors at any time. If an error results in an incorrect price, we may cancel the order (per Section 2) and issue a full refund.

5. Shipping & Delivery

• All shipping and delivery terms are governed by our Shipping Policy (incorporated into these Terms by reference). Key provisions of the Shipping Policy apply to all orders, including:
  • Order processing time (1–3 business days).
  • U.S. domestic shipping only (trusted carriers, tracking included).
  • You are responsible for providing an accurate shipping address (we are not liable for delays/lost packages from incorrect addresses).
  • Delivery times are estimates only (we are not liable for carrier delays).
  • Risk of loss, damage, or theft of the Products passes to you once the Products are shipped to the shipping carrier (per the UCC).
   

6. Returns, Refunds & Exchanges

• All returns, refunds, and exchanges are governed by our Return & Refund Policy (incorporated into these Terms by reference). Key provisions apply to all orders, including:
  • Eligible returns require a request within 14 days of delivery (unused, unworn, original packaging).
  • A valid RA number is required for all returns (unauthorized returns are rejected).
  • No direct exchanges (return for refund, then place a new order).
  • Damaged/incorrect/defective Products must be reported within 3 days of delivery (we cover all costs for resolution).
  • Original shipping and return shipping costs are non-refundable (unless our error).
   

7. Intellectual Property

• All content on the Site (including but not limited to text, logos, images, graphics, Product designs, trademarks, copyrights, layout, and branding) is the exclusive intellectual property of Vickie Darlene LLC and is protected by U.S. and international intellectual property laws (copyright, trademark, patent).
• You may not copy, reproduce, distribute, modify, adapt, publicly display, publicly perform, republish, download, store, or transmit any Site content for any commercial or non-commercial purpose, without our prior written consent.
• You may not use our trademarks, logos, or branding (e.g., “Vickie Darlene LLC”) in any way that is misleading, infringing, or in violation of these Terms.
• All handcrafted jewelry designs are our exclusive property—unauthorized reproduction or sale of our designs is strictly prohibited and will result in legal action.

8. Prohibited Use of the Site

• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Site’s security, functionality, or operation (e.g., hacking, introducing malware/viruses, overloading servers).
• Harvest, collect, or store personal information of other Site users (e.g., email addresses, shipping information).
• Submit false, inaccurate, or incomplete information for orders, accounts, or customer service inquiries.
• Use the Site to send unsolicited commercial communications (spam) or harmful content (hate speech, harassment).
• Violate any intellectual property rights (e.g., copying our designs, images, or text).
• Attempt to gain unauthorized access to our systems, customer data, or restricted areas of the Site.

9. Limitation of Liability

• Damage, loss, or wear of Products from improper care, storage, handling, or use.
• Lost, stolen, or delivered-but-undelivered packages (per our Shipping Policy).
• Carrier delays or shipping issues (per our Shipping Policy).
• Minor handcrafted variations in Products (not considered defects).
• Third-party website content or privacy practices (per our Privacy Policy).

10. Disclaimer of Warranties

• Implied warranties of merchantability (fit for ordinary use).
• Implied warranties of fitness for a particular purpose (the Product will meet your specific needs).
• Implied warranties of non-infringement (the Product does not infringe on any third-party intellectual property rights).
• Warranties of accuracy, completeness, or reliability of Site content.
• Warranties that the Site will be uninterrupted, error-free, or free of malware/viruses.

11. Governing Law & Dispute Resolution

• These Terms and all disputes arising out of or related to the Site, Products, or your order shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.
• Any dispute, claim, or controversy arising out of or related to these Terms, the Site, or your purchase of Products shall be resolved exclusively in the state or federal courts located in Pottawatomie County, Oklahoma, and you consent to the personal jurisdiction of these courts.
• You waive any right to a jury trial in any dispute arising out of or related to these Terms or the Site.

12. Changes to These Terms

• We may update or revise these Terms at any time, in our sole discretion, without prior notice to you. All changes will be posted on this page with a revised Last Updated date—this is the only notice you will receive of changes.
• Your continued use of the Site or purchase of Products after the revised Last Updated date constitutes your unconditional acceptance of the updated Terms.
• If you do not agree to the updated Terms, you must immediately stop using the Site and purchasing our Products.

13. Severability

• If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect.

14. Entire Agreement

• These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Vickie Darlene LLC with respect to the Site and your purchase of Products. These Terms supersede all prior oral or written agreements, understandings, or representations between you and us.
